What makes Virginia different for sober living operators?

Virginia defines recovery residences as alcohol- and drug-free housing without clinical services, but local zoning rules create the real operational constraints, according to the Vanderburgh House 2026 Operator Guide.

Virginia law specifically prohibits recovery residences from mandating clinical services as a condition of housing, Investigate RVA reports. This matters because it keeps you out of healthcare regulations. But it also means you can't require residents to attend your affiliated treatment programs.

Zoning kills more Virginia projects than anything else. Each city and county sets its own rules. Most local codes cap unrelated adults at three to five people, which creates a problem when standard single-family homes in Virginia Beach typically house 6-10 residents. Larger properties can accommodate 10-14 residents, but you'll need special exceptions in most jurisdictions.

The tenant rights situation is stark. Residents in certified recovery homes have zero tenant protections under Virginia law. The 2022 legislation that exempted recovery residences from the Virginia Residential Landlord and Tenant Act gives operators broad eviction powers, according to Investigate RVA.

Certification renews every two years. New regulations are coming. HB931 directs the State Board of Behavioral Health and Developmental Services to write formal rules for the industry, according to the bill text. The regulatory framework that doesn't exist today will exist tomorrow.
